Privacy Policy
Last updated: October 6, 2026
CalorieGenius (“CalorieGenius,” “we,” “our,” or “us”) respects your privacy. This Privacy Policy explains what information we collect, how we collect it, how we use it, who we share it with, and your choices.
By using CalorieGenius, you agree to this Privacy Policy.
1. Scope
This Privacy Policy applies to the CalorieGenius mobile app, our website at https://caloriegenius.app, and related services.
2. Information We Collect
We collect information in the following categories.
A. Information you provide directly
- Account information, such as name, email address, and sign-in method
- Profile information, such as date of birth, gender, weight, height, unit preferences, calorie goals, and other settings you enter; in updated versions, your confirmation that you are aged 18 or older
- Nutrition and activity entries you create, including food logs, exercise logs, and related notes
- Messages or support requests you send to us
B. Information collected from device features (with your permission)
- Camera/photos: food images you capture or select for analysis
- Microphone/audio: voice recordings used for AI transcription when you use voice input
- Health data (Apple HealthKit): step-related data and related calorie estimates, only if you grant Health permissions in iOS
C. AI feature content
When you use AI features and provide consent, we may process:
- Text prompts you type
- Food photos you submit for analysis
- Voice recordings and/or transcription input
- Profile values needed to improve exercise and calorie estimates (for example: weight, height, gender, and units)
- AI outputs returned to you (such as calorie/macronutrient estimates and assistant responses)
D. Automatically collected information
- App usage and analytics events (for example, feature usage, screen views, and performance signals)
- Device/app technical data such as app version, OS version, and identifiers needed for service reliability and fraud prevention
E. Purchase and subscription data
- Subscription status and entitlement information from Apple’s in-app purchase systems
- We do not receive your full payment card number
3. How We Collect Information
We collect information:
- Directly from you when you create an account, fill profile fields, log food/exercise, or contact support
- Automatically through SDKs and backend services used to operate the app
- From device permissions (camera, microphone, HealthKit) only after you grant permission
- From authentication providers (for example, Sign in with Apple or Google) when you choose those methods
4. How We Use Information
We use information to:
- Provide core app functionality (account, syncing, calorie tracking, logs, progress)
- Personalize estimates and recommendations based on your profile and entries
- Power AI features such as food analysis, calorie/macro estimates, coaching, and transcription
- Maintain app security, reliability, and abuse prevention, and check eligibility for our adults-only service
- Measure performance and improve product quality
- Provide customer support
- Comply with legal obligations and enforce our terms
5. AI Data Sharing and Consent
CalorieGenius offers optional AI features using OpenAI and Google’s Gemini API. The provider used depends on the feature and app version. With your permission:
- Google (Gemini API) receives food photos and accompanying meal information you submit, such as descriptions, ingredients, measurements, clarification answers and corrections, to estimate food quantities, calories and nutrients. Previous meal estimates may also be included when you request a correction.
- OpenAI receives chat messages, relevant conversation history, meal information and profile context needed for coaching, food and exercise estimates. On iOS, OpenAI also receives voice recordings when you use AI transcription. On Android, voice input is handled by your device’s speech-recognition service; the resulting text may be sent to our AI providers for the feature you request.
- In updated versions, when you attach a food photo in chat, Google analyzes the photo and OpenAI receives the resulting meal estimate as text to prepare the chat response and requested app action. Google does not receive your full coaching conversation or profile through this photo-analysis step.
Before sending data to these AI providers, the app explains the sharing and asks for permission. Users who previously consented only to OpenAI are asked again before using the updated AI features. Older app versions may continue to send food photos and other AI inputs to OpenAI under their existing consent; they do not begin sending data to Google automatically.
If you decline permission, the corresponding AI features remain unavailable. You can withdraw permission at any time in Settings > AI Privacy. Withdrawal stops future AI sharing; it does not undo processing that has already occurred or itself delete previously retained records.
Provider policies: OpenAI Privacy Policy and Google Privacy Policy. Gemini processing is also governed by the Gemini API terms.
6. Who We Share Information With
We may share information with these categories of recipients, only as needed:
- Service providers and infrastructure partners (cloud, auth, storage, analytics, notifications)
- AI providers: OpenAI and Google (Gemini API), with your permission and for the purposes described in section 5
- Authentication providers (Apple, Google)
- Advertising/measurement providers (where applicable and permitted)
- Payment platforms (Apple)
- Legal authorities when required
- Successor entities (merger/acquisition cases)
We do not sell your personal information.
7. Data Retention
We retain personal data as long as necessary to:
- Provide the service
- Maintain your account
- Comply with legal obligations
- Resolve disputes
When no longer needed, data is deleted or anonymized.
Our retention practices are separate from those of our AI providers. We use the Gemini API through a paid-service project. Under Google’s paid-service terms, prompts and responses are not used to improve Google’s products; Google may retain them for a limited period for security, abuse prevention and required legal or regulatory disclosures. Provider processing and retention are governed by the applicable service terms and privacy policies linked in section 5. Revoking AI permission does not itself delete previously retained records.
8. Data Security
We use reasonable safeguards to protect your data. No system is 100% secure, but access is restricted to authorized parties.
9. International Data Transfers
Your data may be processed in other countries. We apply appropriate legal safeguards where required.
10. Your Choices and Rights
You may have rights to access, correct, or delete your data.
You can:
- Update your profile
- Toggle AI data sharing
- Manage permissions in iOS Settings
- Manage notifications
- Delete your account (if available)
To request data access or deletion, contact us.
11. Adults-Only Service and Children’s Privacy
CalorieGenius is intended only for adults aged 18 and older. Individuals under 18 must not use the app. Updated versions ask users to confirm that they are at least 18 before using the app and check an existing profile birth date, where available. This confirmation is self-reported and is not identity verification.
Existing users who are under 18 should stop using the app and contact us for assistance with their account and data. If you believe an individual under 18 has provided personal information, contact contact@acedigitallabs.com so we can investigate and take appropriate steps to delete that information, subject to applicable legal requirements.
12. Third-Party Links
We are not responsible for third-party privacy practices.
13. Changes to This Policy
We may update this policy. Changes will be posted here with a new “Last updated” date.
